Overtime pay calculator under Turkish Labour Law Art. 41
Under Article 41 of the Turkish Labour Law, overtime pay is the hourly normal wage raised by fifty per cent for every hour beyond forty-five hours a week. If the contract sets a shorter week, the hours between it and forty-five are paid with a twenty-five per cent premium. The form applies the same rule to your numbers.
Each overtime hour is paid at the hourly normal wage plus fifty per cent, and each extra hour below forty-five at plus twenty-five per cent. The employee may take time off instead: one hour thirty minutes for each overtime hour, one hour fifteen minutes for each extra hour. The yearly total cannot exceed two hundred and seventy hours.
How do you calculate your overtime pay?
Enter the hourly normal wage, the contract week and the two kinds of extra hours; the result shows the gross premium pay or, if you choose, the time off instead. If you also enter the yearly total, you get a warning against the two hundred and seventy hour cap. The numbers you enter never leave your browser.

How does Labour Law Art. 41 define overtime?
Overtime is work beyond forty-five hours a week under the conditions set in the law. Where averaging applies, weeks above forty-five hours do not count as overtime as long as the weekly average stays within the normal limit. Work beyond a contract week shorter than forty-five hours, up to forty-five, is extra hours. Overtime requires the employee's consent.
| Case | Pay | Time off instead |
|---|---|---|
| Each hour beyond forty-five a week (overtime) | Hourly normal wage plus fifty per cent (Art. 41/2) | One hour thirty minutes (Art. 41/4) |
| Each hour beyond the contract week, up to forty-five (extra hours) | Hourly normal wage plus twenty-five per cent (Art. 41/3) | One hour fifteen minutes (Art. 41/4) |
| Yearly total | Cannot exceed two hundred and seventy hours (Art. 41/8) | Time off is used within six months, without pay cuts (Art. 41/5) |

How is it calculated?
The calculator asks for the hourly normal wage, the contract week, and the two kinds of extra hours. Overtime hours are multiplied by one and a half times the wage, extra hours by one and a quarter times. If time off is chosen, the hours and minutes earned are shown instead of pay. If a yearly total is entered, a warning is given against the two hundred and seventy hour cap.
- If you are paid monthly, find the hourly normal wage with the method in your payslip or contract; the tool does not suggest a divisor.
- If the contract week is forty-five hours there are no extra hours; leave that field empty.
- The numbers you enter are processed only in your browser; the form is not sent anywhere.
What does this calculation not cover?
The calculation shows the gross amount and makes no tax or social security deductions. A collective or employment agreement may set a higher premium; underground mining, night work and overtime for compelling reasons follow separate rules. For a definite answer consult your accountant or an employment law adviser.
- When is time off used?
- If the employee chooses time off instead of premium pay, it is used within six months, during working hours and without any cut in pay (Labour Law Art. 41/5). Which days the time off falls on is set by workplace practice.
- Does the employee have to consent to overtime?
- Yes. Labour Law Art. 41/7 requires the employee's consent to extra work; Art. 9 of the Overtime Regulation requires the consent in writing, kept in the personnel file. The employee can withdraw consent with thirty days' written notice.
- What does the yearly two hundred and seventy hour cap cover?
- The law says the total extra work in a year cannot exceed two hundred and seventy hours (Art. 41/8). When you enter this year's earlier hours, the calculator compares the total with the cap and warns if it is exceeded.
